Abstract

This study explores the prevalence of cognitive biases through primary and secondary research in various legal aspects. Cognitive biases can significantly affect various aspects of legal practice, such as investigations, judicial proceedings, and contract formation. The study utilises a focus-group experiment revealing distinct confirmation bias patterns. The results confirm the hypothesis of a significant role played by confirmation bias in legal decision-making, underscored by the interplay of cognitive biases, socio-political contexts, and emotional factors. The integration of psychological insights and research with legal practices may prove to be vital to mitigate biases and foster fairer decision-making to improve the overall functionality of our justice system.
